I followed a number of links from your post. The articles cited are absolutely appalling! More than a few recommend opt-out ePending.
Let me give these email marketing geniuses a tip: If I get an email asking me to opt out if I don't want to be added to their email list, I block their mail immediately. That's permanently, including any parent domains, with no appeal. The only reason I'd remove the block is if one of my users asks for it; note: none have ever asked.

I don't disagree with you, and opt-out is bad on every level. It was nice to see Mark Brownlow highlight how stupid people are to recommend it.
