CAN-SPAM Plaintiff Spanking Appeal Rejected

Venkat Balasubramani has the story over on Eric Goldman's Technology & Marketing Law Blog (say that ten times fast).

The players: Asis Internet Services v. Azoogle.com, Inc. The situation: "The Ninth Circuit recently rejected two appeals brought by CAN-SPAM plaintiff Asis Internet Services. The trial court granted summary judgment in favor of Azoogle and awarded costs. See Eric's earlier blog post on that ruling. Asis has brought numerous lawsuits against different defendants. While this ruling won't necessarily be used preclusively against Asis it will definitely be cited by the defendants in those cases." Read it here...

Also: Another cite of Gordon v. Virtumundo. (Thanks again, James Gordon, for, in my opinion, making it harder for smaller ISPs to find success taking action against alleged email bad actors.)
